California Workplace Violence Prevention Laws
Effective July 1, 2024, California Senate Bill 553 (SB 553), codified under California Labor Code Section 6401.9, requires most California employers to comply with workplace violence prevention standards established by the California Division of Occupational Safety and Health (Cal/OSHA). Under these requirements, covered employers must meet several key compliance obligations, including:
1. Developing and implementing a Workplace Violence Prevention Plan (WVPP), either as a standalone program or integrated into the organization's Injury and Illness Prevention Program (IIPP).
2. Providing workplace violence prevention training to employees upon implementation of the WVPP and annually thereafter, including workplace violence prevention procedures, hazard recognition, reporting protocols, and employee rights under the law.
3. Establishing, maintaining, and documenting procedures for reporting, investigating, and responding to workplace violence incidents, concerns, and hazards.
4. Maintaining a Violent Incident Log to document and track reportable workplace violence incidents in accordance with California Labor Code Section 6401.9.
5. Conducting workplace violence hazard assessments and implementing corrective actions to identify, evaluate, and mitigate workplace violence risks.
6. Implementing required recordkeeping practices, including the retention of training records, incident investigations, hazard assessments, and Violent Incident Logs in accordance with Cal/OSHA standards and compliance requirements.
Failure to comply with California Labor Code Section 6401.9 and SB 553 may result in regulatory penalties, citations, and increased organizational risk.
